These Terms and Conditions ("Terms") govern your access to and use of the websites, online applications, communications programs, and other online services offered by Spring Oak Management, LLC d/b/a Spring Oak Senior Living, together with its parent company, subsidiaries, affiliated entities, and communities operating under the Spring Oak name or any other associated brand name (collectively, the "Company," "we," "us," or "our"). By accessing or using our websites or online services, you agree to these Terms. If you do not agree to these Terms, please do not use our websites or online services.
Our websites and online services are intended for individuals 18 years of age or older. By using our services, you represent that you are at least 18 years old. Our websites and online services are not directed to children.
If you provide us with your phone number, email address, or other contact information, we may use that information to communicate with you regarding the reason you provided it, including matters related to an employment application, employment, residency inquiry, tour, residency, account, billing matter, volunteer inquiry, or other request.
Where you have opted in to receive text messages, or where otherwise permitted by applicable law, the Company may send text messages to the mobile number you provide. Messages may include communications regarding applications, interviews, scheduling, tours, residency inquiries, appointments, account matters, billing, surveys, or other matters related to your interaction with us. Where required by law, we will obtain separate consent before sending automated or marketing text messages.
By opting in to text messaging, you understand that message frequency may vary and message and data rates may apply. Consent to receive marketing or automated text messages is not required as a condition of employment, residency, purchasing any goods or services, or otherwise doing business with the Company. You may opt out of text messages at any time by replying "STOP" to a message. You may reply "HELP" for assistance. Opting out of text messages will not affect your application, employment, residency status, or eligibility for our services, although we may need to communicate with you through another method.
We may send email communications to the email address you provide, including application or interview updates, scheduling information, residency communications, billing and account notices, required notices, surveys, and, where applicable, informational or promotional communications about our communities or services. You may unsubscribe from marketing or promotional emails using the unsubscribe link included in those emails. Unsubscribing from marketing emails will not prevent us from sending transactional, account-related, employment-related, residency-related, or legally required communications.
We may contact you by telephone at the number you provide in connection with your application, inquiry, employment, residency, account, or other interaction with us. Where applicable law requires consent before using automated dialing, artificial or prerecorded voice technology, or similar technology, we will obtain the required consent. Standard carrier charges may apply.
Our collection, use, disclosure, and protection of personal information are described in our Privacy Policy. By using our websites and services, you acknowledge that you have access to our Privacy Policy.
You agree to use our websites and services only for lawful purposes and in accordance with these Terms. You may not provide information that you know to be false or misleading; attempt to gain unauthorized access to our systems, accounts, or data; interfere with the operation or security of our websites or services; use automated means to improperly access or collect information from our systems; introduce malicious code or other harmful technology; impersonate another person; or use our websites or services in violation of applicable law.
Submission of an employment application, resume, or other candidate information does not guarantee an interview, offer of employment, or continued consideration for a position. Employment decisions are made separately and are subject to the Company's hiring procedures, applicable law, and any written offer or employment documentation provided by the Company.
Submission of a residency inquiry, care questionnaire, tour request, application, or other information does not guarantee admission to or continued residency at any Spring Oak community. Admission, residency, rates, services, levels of care, and other matters are governed by the applicable community's residency agreement and related documents.
Information provided through our websites or communications is general in nature. We do not guarantee any particular employment outcome, residency outcome, level of care, health or safety outcome, insurance coverage, government reimbursement, financial assistance, or eligibility for any governmental or private program, including Medicaid. Information provided through our websites does not replace the terms of an applicable residency agreement, employment document, service agreement, or other binding agreement.
Information on our websites concerning senior living, assisted living, memory care, wellness, healthcare, or related topics is provided for general informational purposes only and is not intended as medical advice, diagnosis, or treatment. Questions about an individual's medical condition or care should be directed to an appropriate licensed healthcare professional.
Unless otherwise indicated, the text, graphics, logos, photographs, designs, trademarks, service marks, and other content appearing on our websites are owned by or licensed to the Company and are protected by applicable intellectual property laws. You may view and use website content for your own lawful, personal purposes. You may not reproduce, distribute, modify, publicly display, commercially exploit, or create derivative works from our content without our prior written permission, except as permitted by law.
We may use third-party service providers to assist us with functions such as recruiting, applicant tracking, background checks, payments, communications, analytics, information technology, and other business operations. Information provided to these service providers in connection with services they perform for us is addressed in our Privacy Policy.
Our websites may also contain links to websites, applications, or services operated independently by third parties. We do not control those independent third-party services and are not responsible for their content, availability, security, privacy practices, or terms. Your use of an independent third-party service is subject to that provider's own terms and privacy practices.
To the fullest extent permitted by applicable law, our websites and online services are provided on an "as is" and "as available" basis. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that our websites or services will always be available, uninterrupted, secure, or error-free.
To the fullest extent permitted by applicable law, the Company and its affiliated entities, officers, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your access to or use of our websites or online services. Nothing in these Terms is intended to exclude or limit liability that cannot lawfully be excluded or limited.
To the extent permitted by applicable law, you agree to indemnify and hold harmless the Company and its affiliated entities from claims, liabilities, damages, losses, and reasonable expenses arising from your unlawful misuse of our websites or services or your material violation of these Terms.
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law principles, except to the extent applicable federal law or the law of another jurisdiction is required to apply.
We may update these Terms periodically. Updated Terms will be posted with a revised effective date. Where required by applicable law, we will provide additional notice or obtain consent before material changes become effective. Your continued use of our websites or online services after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by applicable law.
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in full force and effect to the extent permitted by law.
